Event Terms & Conditions

Thank you for your interest in participating in the Tough Guy Book Club Camp (the Event). Before you proceed to purchase tickets, we strongly recommend you to go through the following terms and conditions as outlined and facilitated by Tough Guy Book Club Limited (also referred here as TGBC):

In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you - the person who will buy the tickets to the Event. On the other hand, ‘our’, ‘us’, ‘we’, ‘issuer’, ‘provider’, ‘TGBC’ and similar terms will indicate the organisers of the Event - Tough Guy Book Club Limited.

Please note that TGBC reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions without any prior notifications to you. Such changes will be duly reflected on the website of the organiser at https://www.toughguybookclub.com/camp_terms_and_conditions.

1. By opting to purchase, allocate or possess a ticket or ticket instalments to the Event, you automatically agree to our terms of use. If you have problems with any of the clauses listed or do not agree with the risk allocations mentioned here, please do not purchase tickets or attend the Event.

2. A complete ticket is $500 AUD for Victorian residents. This can be purchased in full or as instalments in increments of a minimum of one (1) at $50 AUD to a maximum total of $500 AUD.

3. Non-Victorian residents are eligible for travel subsidies as outlined on https://www.toughguybookclub.com/camp. A complete ticket is $500 AUD less the relevant instalment value outlined by the travel subsidy for non-Victorian residents. Subsidy values subject to change up to sixty (60) days prior to Event.

4. Purchaser liable to retain proof or purchase for each instalment and if necessary provide proof of residency for travel subsidy eligibility.

5. Instalments purchased beyond these totals are assumed to be Solidarity Funds and subject to clauses 21 and 22.

6. New ticket purchases will be available until thirty (30) days prior to the scheduled Event. All outstanding instalments due in full no later than fourteen (14) days prior to the scheduled Event date. Failure to complete payment at these deadlines may prohibit the purchaser’s ability to attend the Event at the discretion of the Organiser.

7. Cancellations to be requested electronically in writing to [email protected] and will be considered received on the date sent.

8. Cancellations requested for any reason at least thirty (30) days prior to the Event are eligible for a refund of the total to date purchased instalments less a 10% (to a max of $50 AUD) administrative recovery fee.

9. Cancellations requested for any reason less than thirty (30) days but prior to fourteen (14) days from the Event are eligible for a refund on the total to date purchased instalments less the contracted per person venue costs and a 10% (to a max of $50 AUD) administrative recovery fee.

10. Cancellations requested for any reason less than fourteen (14) days prior to the Event are ineligible for a refund.

11. Purchased instalments are transferable. Transfer requests to be made in writing to [email protected]. Ticket instalments may only be transferred once.

12. Tickets may not be held by TGBC and deferred for future TGBC Events if purchaser is unable to attend.

13. If you are not able to access the Event - due to delays, federal regulations, organiser policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will not be eligible for any refunds or future credits.

14. If the Event is cancelled in its entirety due to any factors or causes not in the control of the Issuer, the latter reserves the right to reschedule the Event, offer partial or full refund, postpone the Event indefinitely, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, venue closure, and the like. The decision of the Organiser will be considered final and communicated to all ticket holders within three (3) business days of the Event cancellation.

15. Purchasing one (1) or more instalments is understood as an intent to attend the Event and you automatically confirm that you/the attendee is of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending the Event is 18.

16. By participating in a TGBC Event or program, you enter an area where photography, audio, and video recording may occur and consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for web casts, promotional purposes, and inclusion on websites, social media, or any other purpose by TGBC.

17. You release TGBC, its officers and volunteers, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By participating in the Event, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, or other publication of these materials, regardless of the purpose or sponsoring of such use. You also waive any right to inspect or approve any photo, video, or audio recording taken by TGBC or the person or entity designated to do so by TGBC. You have been fully informed of your consent, waiver of liability, and release before participating in the Event.

18. By purchasing tickets to the Event, you give your consent to TGBC to collect certain information about yourself (name, contact details, address, etc.) for verification and storage as required for purposes related to the Event.

19. The Organiser does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

20. Participation in the Event is understood to be entirely voluntary and comes with inherit risks associated with Event activities. As such, TGBC shall not be held responsible for any injuries, damages, penalties, claims or losses including legal expenses incurred by the purchaser or any other person caused by the participation during or travel to and from the Event. The purchaser agrees to reimburse TGBC for, and to defend TGBC against any claims for such losses, damages, penalties, claims, injuries or expenses. This indemnity shall continue even after the Event has occurred.

21. Solidarity tickets are understood to be general purpose funds and purchasers relinquish rights to direct the use of these funds.

22. Solidarity tickets are ineligible for refunds as outlined in clauses 7, 8, 9 and 10. Funds provided in this manner will be retained in the instance of Event cancellation and redeployed for ‘Good Works’ as aligned to TGBC’s charitable purpose.

23. These Terms are governed by and are to be construed in accordance with the laws applicable in Victoria, Australia.
